These Terms of Service (“Terms”) govern your access to and use of bandmanifesto.com and the content, features, communications, and services made available through it (collectively, the “Site”). The Site is operated by Polymath Adventures, LLC under the Band Manifesto name (“Band Manifesto,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 13 years old to use the Site. If you are under the age of legal majority where you live, you may use the Site only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf. You may not use the Site if doing so would violate applicable law.
2. What Band Manifesto Provides
Band Manifesto publishes commentary, ideas, education, recommendations, interviews, and other material about bands, music-making, live performance, promotion, technology, equipment, and related subjects. We may change, suspend, or discontinue any part of the Site at any time without liability to you.
3. Information and Safety Disclaimer
Site content is provided for general informational and educational purposes. It is not legal, financial, medical, tax, engineering, electrical, structural, rigging, hearing-health, or other professional advice. Music and live-event work can involve risks including high sound levels, electricity, suspended loads, heavy equipment, vehicles, crowds, and temporary structures. Conditions vary, and an article cannot account for every venue, product, code, or situation.
Use qualified professionals where appropriate, follow manufacturer instructions and applicable laws and codes, wear suitable protective equipment, and independently verify information before acting on it. You are responsible for your own decisions, purchases, work, and safety. Never treat Site content as a substitute for an appropriate professional inspection, diagnosis, training, or license.
4. No Guaranteed Results
We do not guarantee that any strategy, recommendation, product, rehearsal method, marketing idea, booking approach, business practice, or technical configuration will produce a particular creative, commercial, financial, or performance result. Examples and opinions may reflect individual circumstances that do not apply to you.
5. Acceptable Use
You agree not to:
- Use the Site for unlawful, fraudulent, abusive, threatening, harassing, defamatory, or discriminatory purposes;
- Infringe or violate intellectual-property, privacy, publicity, contractual, or other rights;
- Post or transmit malware, harmful code, spam, unauthorized advertising, or deceptive material;
- Attempt to gain unauthorized access to the Site or another user’s account, device, or data;
- Interfere with the Site’s operation, security, or availability;
- Scrape, crawl, harvest, or use automated means to access the Site in a manner that places an unreasonable burden on it, circumvents access controls, or violates applicable law;
- Impersonate another person or misrepresent your identity, affiliation, or the source of content;
- Collect or expose another person’s personal information without proper authorization; or
- Encourage or help another person do any of the above.
We may investigate suspected violations and may remove content, restrict access, preserve relevant records, or cooperate with lawful requests when we reasonably consider it appropriate.
6. Intellectual Property
Unless otherwise stated, the Site and its original text, graphics, photographs, illustrations, logos, designs, audio, video, downloads, arrangement, and other content are owned by or licensed to Band Manifesto and are protected by intellectual-property laws. “Band Manifesto” and associated branding may be trademarks or service marks of their respective owner.
We give you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for personal, noncommercial purposes in accordance with these Terms. You may share links to public Site pages and quote limited portions for commentary, criticism, news reporting, teaching, scholarship, or research where permitted by law and with appropriate attribution. No other reproduction, republication, sale, distribution, public display, modification, or creation of derivative works is allowed without prior written permission.
Nothing in these Terms limits rights that applicable law grants you, including fair use.
7. User Contributions
The Site may allow comments, messages, submissions, or other user-provided material (“User Contributions”). You retain ownership of your User Contributions. By submitting a User Contribution to an area intended for publication, you grant Band Manifesto a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, format, adapt for technical or editorial presentation, publish, display, distribute, and promote that contribution in connection with the Site and Band Manifesto. This license lasts for as long as the contribution is used on the Site or in related promotional archives. To the extent reasonably practicable, we will honor a request to remove your contribution from future public display, but copies may remain in backups, archives, quotations, or materials already shared by others.
You represent that you own or have all permissions necessary for your User Contributions; that they are accurate to the best of your knowledge; and that our permitted use of them will not violate law or anyone else’s rights. Do not submit confidential material, unreleased music, recordings, photographs, personal information, or other content unless you have authority to do so.
We are not obligated to publish, monitor, preserve, or return User Contributions. We may edit for formatting or clarity, reject, remove, or disable access to any contribution at our discretion, including content we believe violates these Terms or could harm the Site or others. User Contributions express the views of their authors, not necessarily Band Manifesto.
8. Suggestions and Unsolicited Ideas
If you send us feedback or suggestions about the Site, you grant us permission to use them without restriction or compensation. Please do not send confidential business plans, song ideas, lyrics, compositions, recordings, or other creative work unless we have specifically agreed in writing to review it. Receiving unsolicited material does not create a confidential, fiduciary, or professional relationship and does not prevent us from developing or publishing similar ideas independently.
9. Affiliate Links, Advertising, and Reviews
The Site may include advertising, sponsored content, complimentary products, or affiliate links. If you follow an affiliate link and make a purchase, Band Manifesto may receive a commission at no additional cost to you. We will disclose material relationships where required.
Recommendations and reviews reflect the author’s honest opinion at the time of publication, but products, prices, specifications, availability, and third-party policies can change. You are responsible for evaluating a product or service before purchasing it. A manufacturer, retailer, advertiser, or affiliate program—not Band Manifesto—is responsible for its products, services, transactions, warranties, shipping, returns, and customer support unless we expressly state that we are the seller.
Advertising and sponsorship do not necessarily constitute our endorsement of every claim made by a third party.
10. Third-Party Links and Services
The Site may link to or embed websites, stores, ticketing platforms, social networks, videos, audio, software, and services operated by third parties. We do not control and are not responsible for their content, availability, security, terms, privacy practices, products, or services. A link does not necessarily imply endorsement. Your dealings with third parties are between you and the third party, and you access them at your own risk.
11. Copyright Complaints
We respect intellectual-property rights. If you believe that material on the Site infringes your copyright, email contact@bandmanifesto.com with the subject line Copyright Notice and include: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a statement of your good-faith belief that the use is unauthorized; a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act; and your physical or electronic signature.
We may remove or restrict access to material in response to a valid notice. Knowingly misrepresenting that material is infringing may expose you to liability. This section is general contact guidance and does not represent that we have appointed or registered a statutory DMCA agent.
12. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED AS IS AND AS AVAILABLE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR ITS SERVERS ARE FREE OF HARMFUL COMPONENTS.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BAND MANIFESTO, POLYMATH ADVENTURES, LLC, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRIBUTORS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM RELIANCE ON SITE CONTENT; OR DAMAGES ARISING FROM THIRD-PARTY PRODUCTS, SERVICES, LINKS, OR CONDUCT.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS OR THE AMOUNT YOU PAID DIRECTLY TO US FOR THE SPECIFIC SITE SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not exclude liability that cannot lawfully be excluded or limited.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Band Manifesto, Polymath Adventures, LLC, and their owners, officers, employees, contributors, contractors, and agents from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising from your User Contributions, your misuse of the Site, your violation of these Terms, or your violation of another person’s rights. We may assume control of the defense of a matter subject to indemnification, and you agree to cooperate. This section does not require a consumer to indemnify us for our own unlawful conduct where such a requirement is prohibited.
15. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any legal action arising from the Site or these Terms must be brought in the state or federal courts located in Riverside County, California, and you consent to their jurisdiction and venue.
Nothing in this section deprives a consumer of non-waivable protections or rights to bring a claim in another forum under applicable law.
16. Changes to These Terms
We may revise these Terms from time to time. We will post the updated version on this page and change the Last updated date. If a change is material, we may provide additional notice. Unless otherwise stated, revised Terms take effect when posted. Your continued use of the Site after revised Terms take effect constitutes acceptance of them.
17. Termination
You may stop using the Site at any time. We may suspend or terminate access to all or part of the Site if we reasonably believe you violated these Terms, created risk or legal exposure, or harmed the Site or another person. Provisions that by their nature should survive termination will survive, including intellectual-property, license, disclaimer, limitation-of-liability, indemnification, and dispute provisions.
18. General Terms
These Terms and the Privacy Policy are the entire agreement between you and us concerning the Site unless a separate written agreement applies to a particular service. If any provision is held unenforceable, it will be modified only to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a reorganization, sale, or transfer of the Site or our business.
Headings are for convenience only. The word including means including without limitation. Nothing in these Terms creates an employment, agency, partnership, joint-venture, fiduciary, or franchise relationship.
